Can we apply two labors with different companies for single person in PERM ?
my labor is approved with B company in Aug2010.
my employer (company A - holding my h1) also applied labor in July2010.
they are called employer and want to visit company and consultant work place
USCIS visited wrong address and they mailed to my employer like below
1) If MR. is employed by your organization;
2) The start date of MR. employment with your organization;
3) The specific geographic location and physical address MRs working at;
4) The current client that MR is assigned to. Please also provide contact information for a representative of that end client and a copy of the contract. You also indicated that you have filed a new LCA with the Department of Labor � please provide a copy of that LCA.
5) The specific job duties that MR is performing;
6) And the current annual compensation of MR.. Please provide a copy of the IRS Form W-2 issued to MR for 2009 as well as recent payroll documentation for July 2010 to present.
I am working in Govt client,I can provide above all the documents except may not provide representative name and number.
how can i manage this situation,please give me suggestion and share your experiences.

I have not seen the language of the bill. Has anyone seen the exact language of the bill?
Should this bill become law (in its present form without any changes ) will the new provisions apply to ANY H1B application (i.e new applications, Transfer due to change of employer , H1B extension application with current employer) or just to NEW H1B applications and not to H1B extensions filed by the currentemployer.

Got the CPO ordered email on 09/16/2010, updated to Post Decision Activity on 09/17/2010 for both primary and derivative.
Got FP appointment scheduled in the first week of Sep, but gave it earlier ( last week of august)

I agree with immi2006. We set ourselves apart by the Flower campaign indicating that we are law abiding and peaceful.
If some one can come up with a format which shows the tax dollars we have paid so far and the social security we have contributed and we can extrapolate it to encompass the total estimated number of EB immigrants. That would be a sizable number and will wake everyone up. If we distribute this to all the Senators/Congressmen and media it could have a huge impact.
Maybe all IV members can send the two figures:
Lifetime tax paid- One figure
Contribution to SS- One figure
We can put this in a presentable format with a write up and publish it. More ideas and thoughts please.

Good question:
The idea here is to prevent people in EB3 line to come in EB2 line. If you are already in EB2 line your are not affected. If you have masters you should be able to port.
I have a small doubt here. I'm still trying to understand this porting business. Why is that those who have already applied in EB2/Masters will not be affected?
If people with earlier PD port to EB2, it will make my processing longer, no? (IFF my PD is later than theirs')

USCIS should be providing all basic information on cases on case status area of the website. This would reduce number of calls to USCIS and reduce such posts where each conversation with an IO generates some information and misinformation on forums. This feeds to rumors and incorrect information circulated on forums. While such information helps generate lot of threads, page views and ad revenue for other websites, As an organization we should be cautioning people about this.
On the donor forum we have posted some tips what you can do get your greencard. There is no need to make calls everyday trying to get status. If your application is outside processing time, you can simply open a service request. There are other options like Ombudsman and local Congressman's office. We have also posted to our members that if if you have tried all options everywhere and you are in a desperate situation, Immigration voice will help its continued donor members.
In my opinion posts such as "storage area, exam area, and where your file is, pre-approved" only drive curiosity and mass calls that will not help processing of your case. We as an educated and mature community should not fall for such information on the forums.

Received 'card production (green card)' approval e-mails for both me and my wife this morning.
IV leaders and IV Texas State Chapter can still count on my voluntary involvement. I love walking through the walkways of the Congress House and the Senate, especially the tram that connects the House and the Senate via the tunnel. ;)

I called them. The rep was aware of the Vonage deal and offered only $ 4 rental and 2.9 cent per min to india. So I am also thinking to move to vonage.
I just talked to them. Rep said they can not match vonage offer.... I am already paying teleblend around $16 per month. I see no reason why I should not pay $9 more to Vonage in order to get Unlimited India Calling plan. (As I also spend atlest $20 - 25 on reliance india call additonally.)

File a 7001 form with the Ombudsman's office. If I remember right, IV had sent in a recommendation for the USCIS to send GC in secure mail.
An official complaint (instead of just email to ombudsman's office) will reassert IV's recommendation.

If you file a 485 thru company B as future employment(used substitution labor) and if company A for which i am currently employed agrees to file labor and assuming the dates would be current and labor is approved. Can i cancel the 485 applied thru company B and apply thru company A for which i am currently workin?

actually it does matter, right. what happens if the dates retrogress significantly for EB2 again, because of the influx of EB3 to EB2 ports? Then EB2 folks with later priority dates will miss the boat.
But the question is whether the EB2 folks who are missing out are getting an "unfair" deal. That is debatable.
Let us assume that EB2 is going to be current in a year or even sooner than that. Given that situation, and arguing that about 500 people jumped ahead into line over you in to EB2 from EB3, still I do not foresee that their GC's will be approved before the people who are already in line, because
1) as FIFO is not being followed by USCIS, probably they are processing cases based on RD,
2) PD porting is effectively done at the time the second I-140 IS APPROVED. At I-485 stage you can only hope to PD recapture and cross your fingers after sending a no fee letter. This will surely would need additional scrutiny, hence is not a so called 'Low hanging fruit'. Even if an EB3 person wants to start his process right now, it will not be probably before a year and half to two years before he/she is ready to port, and by that time you are past the gate or significantly nearer.
so my point of view is if you look at this thing negatively, you would have a Heartburn and related health issues, but if you are positive and an optimist you would deserve what you get.
