Absolutely true, It is torturing the kids for the aspirations of the parents to be seen in the national TV and for award.

I think once the application is pre-adjudicated...that's it!! I don't believe USCIS will spend anymore time and resources to these applications again...until a visa number is available from DOS and they apply the number to the pre-adjudicated application....my 2 cents! I agree with what you say BUT they may open the file again (to verify certain things and not just assign it a visa) once the visa number is available (I guess that is what you are trying to say) ..is that right ?
BTW - I have not read the memo in detail ...it is a waste of time

am not able to be there these days as I am travelling for work during this time. Also, I have 10k United miles with me, and I would be more than happy to donate it to someone who can travel. But I am not sure if 10k is enough for a round trip. If some one has any inputs on this, I am happy to be of some use at atleast by giving away these miles.

Disagree, the reason you see lot of cases with (older PDs but later RDs) still awaiting approval is because when the PDs were current these cases were still not ripe (e.g: they were waiting name check clearance)....

My argument was on when your file will be looked at the first time. Of course, to get visa number numerous conditions, such as PD Currency, name-check, various documents, etc., have to be met. What I meant is that your file will be looked at the first time, only after cases physically received at the center reviewing your case (no matter what RD is shown on your receipt) before your case was recieved, have been looked at.
Thus, even if you name check is cleared, your PD is Current, and you provided all required documents, if there are cases physically received before your case was received (no matter what RD is shown on your receipt) which are still to be looked at (at least once), your file will not be looked at.
Note that when you call Customer Support, they recognize Receive Date what you see in your online status as "...your case was received on...", which may be quite different than RD on your receipt.
Processing Dates published in monthly reports for each center are manually entered by their staff, and do not tell whether those dates mean "no case is pending older than this date", or "at least one case has been dealt with past this date", as the truth is something in between.
Of course, internal processing and handling of physical files could be anything but known to the outside world. For example, it is possible that an officer was given a bundle of cases to look at, but then he/she proceeds on leave for 4 weeks, leaving them on desk to work on his/her return.

I am so intrigued by this whole affair � I am not going to comment on USINPAC, however, I know Robinder Sachdev personally and can vouch for him and let us get things clear � about Robinder Sachdev. I am dismayed and sad � and wanted to step up to the plate for our good friend. I hope you will appreciate my spirit.

But they won't file my GC in EB2 category, as I don't meet the 4 yr BS requirement.

1. if your company pays for everything, why such reluctance to put up a few more dollars for your own cause? think of those that pay for everything themselves and still contribute.
2. each contribution to paypal costs, they take a chunk off it. making small 10 buck contribution is really not the intelligent way to go.
3. there used to be a 20/mnth recurring contribution. now it does no exist. what do you want? should we throw out the original 20 buck guys? of course they can continue doing it. i can't imagine why it would put you off? btw we did not really lose any money by going to a minimum of 50- you know why? those who were serious still contributed. others who were whining at that time (why is there not a 10/mnth option) were in many (though not all) cases not going to contribute anyway. this is just fyi.
4. what is 50 bucks a month? step back and think sometime. a family meal/movie? do you indulge yourself occasionally worth 50 bucks?
i think in many cases the answer is yes. the money we need for lobbying ie very large....it's hard to make it form 20 bucks at a time when barely 5% of the membership contributes.
you have the choice hereof donating 100 now and considering it as two 50 buck donations, so your next one will be delayed. there are various ways of looking at this.

we all have a choice. please make a wise one.

Once you invoke your EAD ,your H1 goes void. H4 is dependent on H1 and it should also be void. Assuming it does not go void, then you will enter into another problem when the H4 expired. You will not have any avenue to renew her H4 without you being on H1. I would recommend you to stay on h1 if your wife is on H4.

Now the only thing I'd be missing in such a case would be applying for my EAD anytime soon. If she decides to apply for H1B next year or even go on
F1, then I can apply my EAD and start using it. I'll be on my EAD and she'll be on H1/F1. When my priority date becomes current (in a few years assuming), then I can add her AOS.
Please suggest what should I do now ??

A lot of people seem to be saying this. It seems e-filing AP usually triggers a new FP notice. If this true then it will certainly delay things. We would be better off filing AP by paper.

I filed EAD by paper to TCS and got the "Card Production Ordered" email yesterday (in 14 days) for myself and my wife. My friends who efiled just received finger printing appointment notification and no receipts. Is there same benefit with AP? Please calrify.

I hope the admins keep this thread open and not kill it. I am not sure what the intentions of the OP ( some of you claimed that he wants to create a rift ), but this is definitely a valid concern for all the EB3(I) guys. This is a natural reaction to the frustrations of EB3(I) guys just like the mass upheaval during the July 2007 VB fiasco. Since it was across the board, there were no differences. Now since this involves only EB3(I), there is not much support from IV or others. But in my opinion, this is as much unfair as the Julay VB fiasco.
Some of the EB2(I) guys are worried that their GC dreams would get delayed if there is any Admin fix for EB3(I). For all those individuals in EB2(I) who want to oppose any kind of admin fix for EB3(I), I just want you to think about it. Is it really fair? There are individuals in EB3(I) waiting since 2001 - a total of 8+ years. Don't get me wrong - but some of the EB2(I) guys who have applied as late as 2006 and 2007 are expecting/hoping to get their GC this year if there is a spillover. And I think these are the individuals ( not all of the EB2 guys though ) who are opposing any kind of admin fix ( please dont yell at me or curse me etc...if you are not one among those mentioned, then please dont worry..this is not about you::) Ofcourse i would like each one of us to get GC as soon as possible) to EB3(I).
And I dont see why there will be a rift between EB2 and EB3 if each of us follows net etiquette in positng responses. Let's do some constuctive brainstoming - without getting into perosnal attacks or getting too emotional. Let's do what is right and not what each one of us thinks is right. Then I guess there wont be any rifts. The only thing I am asking is to get EB3(I) to advnace a little bit. I am not asking for it be on par with EB2(I). I hope some of you see a point in my frustration::))

I am from Columbus, Oh. I tried joining the OH chapter but couldn't get any reply. Do you know whom I should give a personal message? Also I am ready to meet or do a conference call to see if we can meet a representative or senator if possible because I see that many people here from Ohio.
